A landlord’s guide to dealing with rent arrears

Ensuring that tenants pay their rent is one of the most common concerns for every landlord to face.

To help you keep on top of rent payments and ensure you are not left with any rent missing, we have put together this quick guide to dealing with arrears.

Record payments

It is important for tenants to keep a record of when rent payments are due and when they have been paid.

The Landlord and Tenant Act 1985 states that ‘Where a tenant has a right to occupy premises as a residence in consideration of a rent payable weekly, the landlord shall provide a rent book or other similar document for use in respect of the premises.’ But we recommend you do the same for tenants who pay their rent monthly.

You will need to provide a statement of rent to your tenant and the court if it proves necessary to issue possession proceedings.

Contact your tenant

If your tenant does not pay rent on the day it falls due, we recommend contacting them the day after it falls due to remind them the payment is due and ask that it be paid immediately.

If tenants do not answer your call or respond to your text/email and/or the rent is still unpaid then contact them again

Your letter should:

  • Confirm the amount in arrears and ask that they pay it immediately or to contact you if they can’t and need some time or want to agree a repayment plan.
  • Request that all future payments are made on time and in full
  • Provide an explanation as to what is likely happen if arrears remain unpaid and/or continue to accrue.

Contact the guarantor

Depending on what is stated within the tenancy agreement and if your tenant has a guarantor you should contact them to inform them that a rent payment has been missed and ask them to make payment.

Again, explain to them what is likely happen if arrears remain unpaid and/or continue to accrue.

In many cases if a tenant doesn’t respond, the guarantor will.

If rent remains unpaid for two months then we recommend seeking legal advice on the options available to you and the actions you can take to recover the possession of your property.

The laws that regulate landlord and tenant agreements can be complicated, but it is important that you are aware of your rights and comply with your obligations.
