Guide to possession proceedings

For residential landlords, the Housing Act 1988 (the Act) is a key piece of legislation.

This brief guide provides general advice to residential landlords wishing to recover possession of their property and/or rent arrears from a tenant. Since 1988 most houses are let under an Assured Shorthold Tenancy (AST).

Unless a tenant leaves voluntarily a landlord must obtain a court order for possession to evict the tenant; failure to do so can result in very severe financial penalties.
