Nightmare neighbours: The steps to resolve a neighbour dispute

If you are not comfortable speaking directly with the neighbour, the mediator can speak with both individuals separately.

The agreement is not automatically legally binding, though, if you wish it to be, it has to be entered through the courts.

Litigation

Litigation over a neighbour dispute should always be the last resort, they tend to be costly and drawn out.

Before any Judge hears your case, they will want to know that you have tried to resolve the issue through different means and that you have a collection of evidence.

Common reasons for litigation are boundary disputes, access disputes, nuisance, trespass and property damage.

Litigation will irrevocably damage relationships with neighbours and could complicate the further sale of your home.
