The risks of writing a Will online: What could happen to your estate?

Online Will writing is becoming a popular avenue for individuals organising their affairs, but there are risks involved that could jeopardise your estate.

It may be seen as the faster way to organise your assets and estate, but that Will could become invalid.

This can leave your entire estate plans in disarray, which is why it is so important to utilise the knowledge and experience of legal experts.

What are the risks of online Will writing?

There is an increased risk of mistakes being made, which could lead to your Will becoming invalid.

Any mistakes, such as unclear clauses and errors in wording and spelling, will raise questions about the Will’s validity.

If your Will does become invalid, it is highly likely your wishes will not be executed and instead distributed as if a Will didn’t exist, through the rules of intestacy.

Online Wills are often structured in a very simple way and drafted in a manner that doesn’t make the Will bespoke and may not cover everything you want it to.

It is also very hard for online Will services to distinguish whether an individual is in the right state of mind or under undue influence.

This lack of measures to check an individual’s capacity or undue influence concerns increases the risk of disputes.

Online Will services may also not be able to advise and support with IHT, which could leave your beneficiaries in a position where they face an unwanted IHT bill.

There is also a lack of regulation to consider. Wills created with the help of a solicitor are fully protected under the compliance regulations that they must follow.

However, not all online Will services are regulated, which could put your estate at risk and may not follow the same standards, meaning your estate is unprotected if something were to happen to that company.

Without expert guidance, you lose the valuable, bespoke advice needed to support you throughout the estate planning process, especially if you have more complex assets to distribute, like business, property and international assets.
